When Faulty Products Harm People, You Need Attorneys Who Are Experienced
to Hold the Companies Responsible.
Alaska Law Allows Alaskans Harmed by Faulty Products to Be Fully Compensated.
In Alaska, corporations and everyone who is in the chain of distribution (i.e. the sellers and the middle men) are strictly liable for defective products that harm people. Product defects include:
Defective Design.
Defective Manufacturing.
Failure to Warn Regarding a Dangerous Condition.
When a defect is proven, Alaska law does not require that the company was negligent in its this design, manufacturing or warnings. It is enough that the defect exists and it caused someone to be hurt.
However, Companies Will Fight Tooth and Nail to Make Sure that They Do Not Pay.
The reasons for this are varied. In some instances, the people in charge really cannot believe that their product could be faulty. This dynamic is rare but real.
More commonly, the issue is simply that there are too many potential claims out there and if they settle one they fear that they will have to settle all of them. Some corporations simply decide that it is cheaper to litigate to the bitter end than it is to pay all of the injured people what they are owed. They hope that claimants will give up, accept reduced offers, or even pass away during the prolonged lawsuits.
Finally, delay can be profitable for the companies. By delaying settlements and prolonging lawsuits, companies can earn interest on the money they would otherwise pay out. For example, 8% interest on a $3 million settlement over two years could yield nearly $500,000 in additional profits.
